irrigation System Installation – Terms and Conditions

1. Prices good at time of estimate.

2. We are VAT registered. GB 2498567463.

3. Errors and omissions accepted.

4. Not all costs and/or services will necessarily be supplied by GILD

5. GILD will provide its own sub-contractors or provide the service of managing contractors hired directly by the client for any installation work as outlined within the proposal. Therefore, from herein GILD represents either a subcontracted

work force or manages contractors hired directly by the client.

6. Initial site visit and consultation is free of charge. Subsequent site meetings and production of drawings will be classed as chargeable and will be charged with travelling time, where applicable, at an hourly rate of £45.00 unless otherwise agreed.

7. From client’s acceptance of order, GILD will schedule and discuss commencement dates. Should the client cancel or delay the scheduled start dates thereafter GILD reserve the right to charge for losses involved.

8. A deposit payment of 30% is required on or before the date of commencement.

9. It is a condition of the quotation that interim invoices will be submitted at pre agreed intervals for materials ordered and received for the project, and for labour expended to date for projects lasting longer than two weeks.

10. All deposit payments will be calculated as part payment of the final invoice.

11. All invoices will be due for payment by return unless otherwise agreed.

12. An interest charge of 2% will be levied on overdue invoices. Failure to settle within 14 days will incur interest at 8% above base rate being added to the total outstanding invoice value in accordance with government legislation.

13. The quotation is valid for a period of 30 days and GILD reserve the right to amend the price after this date.

14. No main contractors discount is included in the quoted price.

15. Where plans are submitted the quotation is based on those plans. GILD reserves the right, before acceptance of any order, to carry out a site survey to satisfy ourselves that the quantities quoted are sufficient.

16. GILD’s sub-contractors or managed contractors will make every effort to carryout installations according to plans. Modifications will sometimes be necessary. Any significant changes/charges will be put in writing to the client and will be subject to client approval.

17. GILD will provide notification of any additional costs and submit such costs in writing. Normally additional works require client approval. Should this, for whatever reason, not be practical/possible we reserve the right to automatically pass the costs to the client with notification to the client at the earliest opportunity.

18. It is the responsibility of the client to notify GILD of any gas pipes, oil pipes, water mains, telephone or electricity cables, sewers or land drains or any other obstructions known, already installed and to provide us with accurate indications showing their routes.

19. GILD cannot be held responsible for costs incurred due to unforeseen circumstances with such gas pipes, oil pipes, water mains, telephone or electricity cables, sewers or land drains or any other obstructions arising at time of excavation, which were not known or disclosed by the client at point of survey.

20. The ground conditions will determine our methods of excavation/installation and will have appropriate effect on the conditions of contract. Normal excavation/installation renders very slight scars to lawn areas for a short period depending on seasonal growth. If ground conditions prove unsuitable for normal excavation/installation alternative methods will be considered. These include mole ploughing, chain trenching and hydraulic bucket trenching. It must be understood by the client that such methods will mix sub and top soils. GILD will carryout remedial work to minimise disruption in this case. In these circumstances, extra charges will be made to the client. GILD will advise of further charges prior to any commencement in incurring these costs.

21. The quotation shall outline any specific requirements where specialist electrical or water supplies are required. The client is liable to cover costs for such installations unless otherwise specified in the quotation.

22. GILD is responsible for the design of irrigation system layout and does not accept any responsibility for alterations, modifications made by other contractors or customers/employees employed on the site.

23. GILD will make every effort to ensure the irrigation system provides adequate application of water but is not responsible for any areas of abnormal drainage/saturation unless the specific areas have been brought to our attention at the design stage.

24. GILD includes on-site tuition and a familiarisation process within the quotation. We do not therefore accept any claim for loss or damage to lawns and planting, pathways or walls resulting from subsequent incorrect programmed watering.

25. Unless otherwise arranged, warranty on items within the quotation will be the same as the warranty given by the manufacturers of the items provided by us.

26. GILD shall not be liable to repair, rectify, reinstate or otherwise correct any part of the work which has been damaged in any way by other contractors or customers/employees employed on the site, or problems brought about by acts of God or other conditions beyond our control.

27. GILD agree to undertake any reasonable remedial works within a period of three months from completion provided proper aftercare by the client can be established.

28. It is the client’s responsibility to notify GILD of special requirements needed to prevent damage/destruction to any component possibly caused by pets.

29. GILD shall not be liable for damage or destruction to any part of the irrigation installation caused by clients own pets or wildlife where costs are incurred to carryout remedial works. GILD will provide quotations for remedial works where required.

30. Should the need for such on site attendance be necessary it is assumed that the client will notify GILD. If remedial works are provided from alternative sources GILD will not be liable for costs/charges incurred.

31. Unless a service contract is agreed in writing the quotation makes no allowance for GILD to provide on site service, repairs, maintenance, back up for the materials and assemblies provided as part of these proposals and prices. It therefore becomes the responsibility of the client to acquire/carryout aftercare/maintenance.

32. Full title to all materials, assemblies and packages supplied will remain with GILD until full payment has been received.

33. Photography may be carried out before, during and after works are carried out and used by GILD for reference/publicity purposes unless expressly refused in writing prior to work commencing

22. The client must inform GILD within 24 hours of delivery of goods to site of any dissatisfaction with the quality of those goods.

23. Unless otherwise arranged, warranty on items within the quotation will be the same as the warranty given by the manufacturers of the items provided by us.

24. Once structures, materials, systems have been installed in their final locations within the landscaping scheme, it is the responsibility of the client to acquire/carryout methods for aftercare/maintenance unless otherwise agreed in writing.

25. Plant material is guaranteed for a period of three months after planting and will be replaced once free of charge providing it/they have not been neglected, vandalised, or died as a result of drought or water logging. This does not apply to the client’s own existing planting which may have been transplanted.

26. The client must accept that all concrete products may exhibit symptoms of a process known as efflorescence, (a subtle white blooming that may give the impression of colour fading). This is not considered detrimental to the product performance. GILD will not accept responsibility for its occurrence.

27. Where timber is used, it must be noted that wood is a natural product and susceptible to the influence of the environment/moisture content in the air and ground. The resultant swelling or shrinkage will create stresses which can lead to surface cracking/splitting. This is considered to be normal and will not lead to weakening of the structural integrity of the feature. Any exchanges of cracked/split timbers at the request of the client will be considered for aesthetic reasons only and will be subject to additional charges.
